In the preliminary hearing for Zachary Ah Nee, Christopher Fredeluces and Geoffrey Thom, both the prosecution and defense wanted the footage to be shown. Because each side believes seeing the shooting, which only took a few seconds of time, but was captured from several different angles -- is critical to proving their case.
The body cam footage showed the actual firing of shots into a stolen white Honda. It also gave those in the court room, along with the judge, each officer's perspective of the incident.
Not just during the last moments when the car was surrounded by police on Kalakaua Avenue, but also during the police pursuit that began in East Oahu.
Two of the three officers involved in a preliminary hearing had body camera footage. Officer Fredeluces did not activate his camera. But Officer Chanel Price, who drew her weapon but did not fire, did record video. She was back on the stand to talk about her concerns once she joined the police pursuit.
"At this point, knowing the criminal history of the suspects, and the recklessness of the vehicle in the pursuit, did you worry the apprehension of these suspects would put the community in danger?" asked Defense Attorney Thomas Otake.
"Yes," she answered.
Much of today's testimony focused on the placement of Officer Fredeluces at the time of the shooting.
The slow motion version of the video shows him by the driver's side door.
"When you look at your body worn camera, at no point does it show Fredeluces in front of the car does it?" asked Prosecuting Attorney Christopher Van Marter.
"I don't know. I would need to review the body cam video again," replied Price.
But the defense countered officers didn't have time to slow things down, in the split second when the car started to move forward.
They said other officers didn't know exactly where Fredeluces was and were concerned for his safety.
"Did Officer Thom fire AFTER that car started moving forward? Did you think Officer Fredeluces life was in danger?" asked Defense Attorney Richard Sing.
"Yes," Price replied to both questions.
Each officer's body camera footage was played once at regular speed then at slower speeds. Which meant members of the the Sykap family watched repeatedly as 16 year old Iremamber Sykap was shot and killed. They could be heard quietly sobbing while those clips played in court.
This preliminary hearing is is now hold, until August 17th, because of scheduling conflicts between attorneys and witnesses. It will pick up with the conclusion of the prosecution's witness, and then begin with the defense's half dozen witnesses.
